Selling an Old Vehicle Without Proper Transfer Can Be a Costly Mistake
If you have an old car or motorcycle lying unused at home and are planning to sell it to a local scrap dealer for a few thousand rupees, think twice. Selling a vehicle without completing the legal ownership transfer can leave you responsible for future accidents, crimes, or legal disputes involving that vehicle.

How the Incident Happened
According to a story shared on social media, a man owned a 20-year-old vehicle whose registration had already expired. Instead of sending it to an authorized vehicle scrapping facility, he sold it to a local scrap dealer for just ₹2,000 using a simple handwritten sale agreement.
The vehicle was handed over, but no official ownership transfer or registration cancellation was completed.
The Scrap Dealer Repaired the Vehicle Instead of Scrapping It
Rather than dismantling the vehicle, the scrap dealer repaired it and began using it on public roads.
Some time later, the vehicle was involved in a serious road accident. The driver fled the scene, leaving the vehicle behind.
Police Traced the Registered Owner
During the investigation, the police identified the vehicle through its engine and chassis numbers. The registration records at the Regional Transport Office (RTO) still showed the previous owner as the registered owner.
As a result, authorities initiated legal action against him.
The accident victim was reportedly the sole earning member of the family. During the court proceedings, the registered owner was ordered to pay ₹2 lakh in compensation because the vehicle was still legally registered in his name.
His claim that he had already sold the vehicle was not accepted, as there was no official transfer recorded with the RTO.
A Simple Sale Letter Is Not Legally Sufficient
Legal experts say that selling a vehicle using only a handwritten sale letter or private agreement does not transfer legal responsibility.
Until the RTO officially transfers or cancels the vehicle registration, the registered owner remains legally responsible for the vehicle under Indian law.
The Correct Way to Scrap an Old Vehicle
If your vehicle has reached the end of its life, it should be scrapped only through a Registered Vehicle Scrapping Facility (RVSF) authorized by the government.
The proper process includes:
- Submit the vehicle to an authorized Registered Vehicle Scrapping Facility (RVSF).
- Obtain a Certificate of Deposit (CoD) as proof that the vehicle has been accepted for scrapping.
- Visit the concerned RTO and apply for cancellation of the vehicle registration by submitting the required documents, including the Registration Certificate (RC), as per the applicable procedure.
- Once the registration is officially cancelled, your legal responsibility for the vehicle ends.

If you previously sold your old car or bike to a scrap dealer or private buyer without completing the official ownership transfer, you should immediately verify your vehicle's status with the RTO.
